A special meeting of the Middle Smithfield Township Board of Supervisors was called to order at 9:00 a.m., Monday, March 03, 2008 at the Schoonover Municipal Center.  Scott Schaller presided.

 

Members present:  Scott R. Schaller, Robert (Bob) Spano Sr. and Ronald (Ron) Clewell.  Also present were Jennifer Wise, Sherry Predmore, Deb Ogden, Wayne Rohner and several interested parties. Gary summers, Al Decker, Mr. Parker, Pat Cusmano, Attorney Dan Lyon and Peter Andrews.

 

Scott Schaller called to order a public hearing to hear the request of Marshalls Creek Food Market, Inc. t/a Four Seasons Restaurant & Diner who is requesting an inter-municipal transfer of a liquor license from Wayne Moore, Guardian of the Estate of Joseph Darlak; the license is currently issued in Coolbaugh Township.  A stenographic record was taken by Diane Pressley.  Jennifer Wise summarized the application and the law that governs the proceedings. 

 

Attorney Dan Lyon represented the applicant.  He called Peter Andrews who gave history of the restaurant and identified the Applicant’s exhibits.  Exhibit #1 was a copy of the liquor license application.  Exhibits 2 through 6 were pictures of the exterior of the restaurant and Exhibits 7-10 were pictures of the interior.

 

Mr. Andrews when asked why he was applying for a liquor license responded that it would be an amenity for guests, they had one before, customers’ requests and that he was losing private parties as he did not have a license.   If obtained he will be operating in a similar way as before.

 

Jennifer Wise stated if transferred any and all licenses would be issued by the Liquor Control Board.  The applicant’s exhibits were admitted. 

 

There were no comments from the public.

 

Scott Schaller made a motion to close the hearing.  Bob Spano seconded the motion.  The motion carried 3-0. 

 

Scott Schaller made a motion to adopt Resolution 03-2008-01 supporting the transfer of the liquor license for Marshalls Creek Food Market, Inc. Bob Spano seconded the motion.  The motion carried 3-0.

 

Attorney Wise reminded those present that the action was not final approval.  Mr. Andrews needs to go to the LCB and meet all their requirements.

 

At 9:25 a.m. the Board moved on to other business.

 

Scott Schaller made a motion to authorize payment of the listed bills.  Ron Clewell seconded the motion.  The motion carried 3-0.

 

 

 

David Squires presented a Minor Subdivision plan for the Josephine Squires Estate.  He explained that the two lots are being created to settle his mother’s estate.  Scott Schaller made a motion to approve the subdivision plan. Ron Clewell seconded the motion.  The motion carried 3-0.

 

It was noted that Ron Clewell has found a truck to be purchased through the piggyback program of the City of Harrisburg.  A resolution has been prepared to allow participation in the program.  Scott Schaller made a motion to adopt Resolution 03-2008-02 as presented.  Bob Spano seconded the motion.  The motion carried 3-0.

 

Scott Schaller made a motion to schedule the spring cleanup for May 29, 30 and 31, 2008; Thursday and Friday from 7:00 a.m. to 5:00 p.m. and Saturday from 7:00 a.m. to 4:00 p.m.  Bob Spano seconded the motion.  The motion carried 3-0. 

 

Scott Schaller made a motion to authorize the secretary to place the advertisement for cleanup containers.  Bob Spano seconded the motion.  The motion carried 3-0.

 

Scott Schaller made a motion to call an executive session for discussion of the LTS litigation.  Ron Clewell seconded the motion.  Executive session was called at 9:40 a.m.

 

The meeting reconvened at 10:15 a.m. upon a motion by Scott Schaller, second by Bob Spano.

 

Pat Cusmano asked several questions regarding the liquor license application heard earlier.  No further action was taken.

 

There being no further business, the meeting adjourned in regular order upon a motion by Scott Schaller and second of Bob Spano.
